Terms of Service & SMS Terms

These Terms of Service (“Agreement”) govern your access to and use of the real estate website, technology platform, comparative market analysis tools, customer portals, and SMS text messaging services provided by State Street Realty LLC d/b/a Century 21 Signature Realty (“Century 21 Signature Realty,” “we,” “us,” or “our”), hosted and operated in partnership with MoxiWorks LLC (“MoxiWorks”) (collectively, the “Site”).

By accessing or using the Site, submitting contact forms, or opting into mobile messaging, you agree to be bound by this Agreement.

1. SMS & MOBILE MESSAGING TERMS (A2P 10DLC COMPLIANCE)

By providing your mobile phone number and consenting to receive text messages from Century 21 Signature Realty, you agree to the following messaging terms:

Program Description & Identification: Messages are sent by Century 21 Signature Realty to provide customer care, respond to property inquiries, deliver property listing alerts, coordinate real estate showings, and provide transactional updates related to buying or selling real estate.

Message Frequency: Message frequency varies based on your interactions, search criteria, and active property transactions. (Typically 1–4 messages per month for general inquiries/alerts).

Message and Data Rates: Message and data rates may apply for any SMS/MMS text messages sent to you from us and to us from you.

Opt-Out Instructions: You can cancel the SMS service at any time. Text STOP to any text message received from us to opt out. After sending STOP, you will receive one confirmation message confirming your unsubscription. No further text messages will be sent unless re-initiated by you.

Help & Support Instructions: If you need assistance or experience issues with the messaging program, text HELP to any text message received from us, or contact our support team at info@c21signaturerealty.com or 989.921.7000.

Carrier Liability Disclaimer: Wireless carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

Privacy & Non-Sharing Commitment: Mobile information, phone numbers, and SMS opt-in/consent data will not be sold, rented, shared, or disclosed to third parties or affiliates for marketing or promotional purposes. All wireless consent data is kept strictly confidential.

2. ACCEPTANCE OF AGREEMENT

By accessing and using the Site, you represent and warrant that:

• You are 18 years of age or older.
• If acting on behalf of an entity, you have full authority to bind that entity.
• You will provide true, accurate, current, and complete information on all form submissions.
• Your use of the Site complies with all applicable federal, state, and local laws.

3. MODIFICATIONS

We reserve the right to modify this Agreement at any time. Changes become effective immediately upon posting to the Site. Your continued use of the Site or mobile services following any modifications constitutes your acceptance of the revised Terms.

4. PLATFORM ACCESS AND PERMITTED USE

Century 21 Signature Realty grants you a personal, limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use in connection with researching, buying, selling, or marketing real property.

Prohibited Conduct: You agree that you will not:

• Use the Site or its contents for any unlawful purpose or in violation of Fair Housing, CAN-SPAM, or TCPA laws.
• Scrape, copy, modify, transmit, broadcast, or create derivative works of property listings, MLS data, or platform content without express written consent.
• Impersonate any person or entity, including agents or staff of Century 21 Signature Realty.
• Introduce viruses, malware, trojans, or logic bombs designed to disrupt or impair platform functionality.
• Send unsolicited advertising, chain letters, or spam.

5. MLS CONTENT AND INTELLECTUAL PROPERTY

Information and property photographs on the Site are provided by local Multiple Listing Services (MLS) and property listing agents.

All MLS data, property disclosures, trademarks, logos, and underlying platform software are protected by copyright, trademark, and proprietary rights laws.

You are granted a limited license to store property reports or listing PDFs on your personal computing devices solely for personal real estate evaluation.

6. USER CONTENT & SUBMISSIONS

Any personal information, feedback, search parameters, or property criteria submitted through the Site (“User Content”) remains your property. However, you grant Century 21 Signature Realty and MoxiWorks a non-exclusive, royalty-free license to host, process, and use such User Content to deliver real estate services to you.

7. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL RELATED SERVICES (INCLUDING SMS MESSAGING AND MLS CONTENT) ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF PROPERTY DATA, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. LIMITATION OF LIABILITY

NEITHER CENTURY 21 SIGNATURE REALTY, MOXIWORKS, NOR THEIR RESPECTIVE BROKERS, AGENTS, OFFICERS, OR AFFILIATES SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF (OR INABILITY TO USE) THE SITE OR TEXT MESSAGING SERVICES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED TEN DOLLARS ($10.00 USD).

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Century 21 Signature Realty, MoxiWorks, and their officers, directors, brokers, agents, and employees from any claims, losses, liabilities, and expenses (including attorney's fees) arising out of your breach of these Terms or misuse of the Site or SMS services.

10. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICES

We respect copyright rights. If you believe any content on the Site infringes your copyright, submit a written DMCA Notice to our designated copyright agent:

11. GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. Any legal action arising from these Terms or use of the Site shall be brought in the state or federal courts located in Saginaw County, Michigan.
